Workers are entitled to paid sick leave. Employers pressure employees not to sue their sick pay benefits or fail to provide information regarding sick pay leave. Most workers are afraid of consequences if they use their paid sick leave.
California Sick Pay Leave
California requires employers to use at least 40 hours or five days, whichever is greater, of paid sick leave per year.
This applies to all employees who work at least 30 days for the same employer and an employee must work for at least 90-days prior to taking any sick leave. This includes part-time, per diem, and temporary employees even if you are employed by a staffing agency.
Typically, employees earn at least one hour of paid sick leave for each 30 hours of work. Some employers use an up-front policy where the employee is provided the full amount of sick leave immediately.
If your Employer is not providing you with sick leave or is pressuring you not to use sick leave, it is time to call the professionals at (800) 365-3258.
